HPW won a significant appellate victory where the Court of Appeals affirmed a jury verdict of approximately $2 million, including attorneys’ fees and punitive damages, in its entirety, that HPW obtained in July 2017 on behalf of a general contractor against a developer for fraudulent transfers following non-payment. In doing so, the Court of Appeals decided that punitive and general damages are available under Georgia’s version of the Uniform Fraudulent Transfer Act, which is the first time an appellate court in Georgia has ruled this way.
